HOW TO REGISTER TRADEMARK UNDER CLASS 25 – FOOTWEAR AND CLOTHES

Trademark Class 25 covers clothing, footwear and headgear. In today’s scenario where on daily basis lots of Brands are launch of Apparels, shoes, clothes it has become requisite to register your Brand Name under IPR provisions in order to save it from the competitors to copy your Brand Name. STEP BY STEP PROCEDURE OF TRADEMARK REGISTRATION UNDER CLASS 25 OF FOOTWEAR AND CLOTHES

1. TRADEMARK SEARCH : The very first step in Trademark Registration is to check the availability of Name that you want to register for Trademark. At the IPR site check the proposed name along with the Class 25 and ensure that name that we are applying is eligible for registration
2. TRADEMARK APPLICATION : Next step is the Application at the IPR portal. At the site of Intellectual Property Rights, Apply through online mode or Physical mode – trademark application and mention all the details including the Brand Name, Logo, Class and attach requisite documents
3. FEES: At the time of submission of Trademark Application, one must pay Trademark Application Fees. Its 4500 in case of Individual, Sole Proprietor and 9000 in case of Partnership Firm, LLP, Company
4. EXAMINATION : After submission of the Trademark Application, it is examined at the Trademark Registry office. If found ok then it is sent to Advertisement in Trademark Journal
5. OBJECTION UNDER CLASS 9 OR CLASS 11: If Found resemblance or similar to any application then Trademark Office marks Objection under Class 9 or Class 11

6. SUBMIT REPLY : For the objections raise, applicant must file its reply and submit reply at the IPR portal

7. ACCEPTED AND ADVERTISED: An application is mark as accept and advertise and it is publish for 4 months in the trademark journal

8. REGISTRATION CERTIFICATE: Once all the statutory time period is completed then Registration Certificate is issue by the Trademark Registry
